Introduction

These terms for the Common Cents Mobile Service Plan are subject to the Common Cents Mobile Terms of Service, which is available on our website (CommonCentsMobile.com).

Common Cents Mobile Current Service Plan

Pay As You Go Plan

We offer a Pay As You Go service plan that allows you to pay by the minute for your voice service. The rate is 7¢ for each minute you use.

Account Status

To use your Common Cents Mobile phone, you must add (“Refill”) at least $10.00 to your Common Cents Mobile account within 150 days of activation. If you do not Refill during this period, your account will expire, you will lose your mobile phone number, and we will assess you a termination charge equal to the balance in your account, which is not refundable.

Your account will remain active (the “Active Period”) for 15 days after you Refill at least $10.00, 30 days after you Refill at least $20.00 ($15.00 if you select the $15.00 Auto Refill option described below), 60 days after you Refill at least $30.00, or 365 days after you Refill at least $150.00, in each case during any 24-hour period.

During the Active Period, you may make calls and use other services, such as messaging or Downloads, if you have a positive account balance sufficient to pay for the services. If you do not Refill again at the end of the Active Period, your account will become inactive on the day following the expiration of the Active Period. If your account is inactive, you may not make or receive calls (other than 911 emergency calls), access Downloads, send or receive messages (unless you purchased a Messaging Pack that has time remaining at the expiration of the Active Period, in which case you will be able to send and receive messages until your Messaging Pack expires), or use any other services, even if you have money in your account.

You must Refill your account during the first 30 days following the expiration of the Active Period to make it active again. Your account will be reactivated for another 15 days after you Refill at least $10.00, 30 days after you Refill at least $20.00 (or $15.00 if you select the $15.00 Auto Refill option), 60 days after you Refill at least $30.00, or 365 days if you Refill at least $150.00, in each case during any 24-hour period. If you do not Refill at least $10.00 within 30 days following the expiration of the Active Period, we will assess you a charge equal to the balance in your account, which is not refundable even if you reactivate your account.

If you Refilled $150.00 and your account was active for 365 days, but you do not Refill at least $10 within 60 days after the expiration of the Active Period, your account will expire, we will deactivate your service, you will lose your mobile phone number, and we will assess you a termination charge equal to the balance in your account. For all other Active Periods described above, if your account is inactive and you do not Refill at least $10.00 within 150 days following the day on which you most recently Refilled at least $10.00, your account will expire, we will deactivate your service, you will lose your mobile phone number, and we will assess you a termination charge equal to the balance in your account, which is not refundable even if you reactivate your account. If your account is deactivated, you must follow the activation process again in order to obtain service and use your Common Cents Mobile phone. You may visit our website (CommonCentsMobile.com) or contact Customer Care at 1-877-477-1737 to reactivate your account using a Refill card, credit/debit card or PayPal account.

Payment Methods

Refill

You may add money to the cash balance of your Common Cents Mobile account by using one of our Refill methods. You can Refill your account by (1) registering your credit/debit card or PayPal account (a “registered payment method”) or (2) buying Refill cards at any of hundreds of retail locations and adding the Refill card value to your account from your Common Cents Mobile phone, on our website (CommonCentsMobile.com), or by calling Customer Care at 1-877-477-1737. If you Refill your account by contacting Customer Care, you may be assessed a processing fee. Refill cards come in increments of $20.00 and $30.00. Sales taxes, and, in certain states, regulatory fees, apply.

You may Refill your account in any amount between $10.00 and $150.00. The maximum amount you may Refill in a single day is $150.00 and the maximum cash balance allowed in an account at one time is $400.00. The value of any Refill amount or Refill card cannot be applied to any other wireless service.

Auto Refill

You may automatically Refill your account (“Auto Refill”) by deducting an amount from your registered payment method and adding it to your Common Cents Mobile account either at the end of the Active Period or when your balance falls below $5.00, whichever happens first. The minimum Auto Refill amount is $15.00.

You can set up, modify, or cancel your Auto Refill preferences on our website (CommonCentsMobile.com) or by calling Customer Care at 1-877-477-1737.

Recurring Charges for Messaging Packs

Your Messaging Pack 30-day cycle starts on the day of the month that you purchase the Messaging Pack. We will deduct the monthly recurring charge for that Messaging Pack from your cash balance every 30 days. If you have an insufficient balance and have authorized a registered payment method, we will charge your registered payment method. If you do not have sufficient funds in your account and have not authorized a registered payment method, or the charge to your registered payment method is declined, your Messaging Pack subscription will be terminated.

No charges will be placed on your registered payment method following (1) your removal of your registered payment method through our website (CommonCentsMobile.com) or by calling Customer Care at 1-877-477-1737; (2) our termination of your Messaging Pack due to payment failure through your registered payment method; or (3) deactivation of your account.

Checking Your Balance

You may check your balance at any time free of charge by pressing the up arrow on your Common Cents Mobile phone or by visiting our website (CommonCentsMobile.com).

Messaging

Rates

The following messaging rates apply:

  • domestic text messages: 7¢ to send and 7¢ to receive.
  • international text messages: 7¢ to send and 7¢ to receive.
  • domestic picture messages: 7¢ to send and 7¢ to receive (picture messages may not be sent to international phone numbers).
  • email messages: 7¢ to send and 7¢ to receive, and 7¢ for each notification message (if you choose not to open the email message, the cost is 7¢ for the notification message only).
  • instant messages (“IMs”): 7¢ to send and 7¢ to receive.

Messaging Pack

You may purchase a subscription for 30 days of unlimited domestic text messages, picture messages, emails and IMs (a “Messaging Pack”) for $20.00. If you do not have sufficient funds in your account to pay your monthly charge, you will be charged 7¢ for each domestic text message, picture message, email and IM, and you will no longer be subscribed to the Messaging Pack. The Messaging Pack does not include international text or picture messages.

You can terminate your subscription for the Messaging Pack from your mobile phone (Downloads > Messaging > Messaging Management) or by visiting the Messaging Settings page on the Common Cents Mobile website (CommonCentsMobile.com).

Data Services

Downloads

Access to the Downloads service is included in the Pay As You Go Plan. There are charges for each item of Content, such as ringtones, wallpaper or graphics, that you download.

Certain Content from the Downloads service is available on a subscription basis and can be selected and canceled at any time through your Common Cents Mobile phone or by visiting the Downloads page on our website (CommonCentsMobile.com). If you agree to a subscription but do not have sufficient funds in your account to pay the subscription price, we will attempt to charge the subscription fee to your account for the next 60 days. You may not access a Content subscription until the subscription price is paid in full. If the subscription is not paid at the end of the 60-day period, your subscription will be terminated and you must re-subscribe if you wish to resume receiving the Content.

All Content accessed from the Downloads service is subject to the sections of the Common Cents Mobile Terms of Service entitled “Specific Terms and Restrictions regarding Data Services” and “Acceptable Use of Our Products and Services.”

Data Pass

To use the mobile Internet, you must purchase data (a “Data Pass”) for $1.00 per 1 megabyte (MB) of data. Other fees, including airtime, data and messaging, may apply to certain Content. Unused data in your Data Pass expires 24 hours after purchase.

Use of Content accessed through the mobile Internet is subject to the terms applicable to the particular websites you visit and is also subject to the sections of the Common Cents Mobile Terms of Service entitled “Specific Terms and Restrictions regarding Data Services” and “Acceptable Use of Our Products and Services.”
